1. Agreement to Terms
By accessing or using the CyberSyon Software website (https://cybersyon.com) or contracting our engineering, software design, and digital transformation services, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you must refrain from using our website and services.
2. Services Scope & Client Engagements
CyberSyon Software provides custom software engineering services including, but not limited to:
- Full-stack Web Application Development and API Engineering
- Native and Cross-Platform Mobile Application Development (iOS & Android)
- Artificial Intelligence (AI) Model Integration and Cognitive Search Systems
- Robotic Process Automation (RPA) and Business Process Automation
- Cloud DevOps, Architectural Modernization, and Technical SEO Services
Specific project milestones, deliverables, payment schedules, and technical requirements are governed by individual Master Service Agreements (MSAs) or Statements of Work (SOWs) executed separately with each client.
3. Intellectual Property Rights
a. CyberSyon Software Ownership
All content, designs, paper-cut visual elements, logo trademarks, source code frameworks, pre-existing libraries, and branding assets on cybersyon.com belong exclusively to CyberSyon Software and are protected under Indian and International intellectual property laws.
b. Client Project Deliverables
Upon final settlement of all agreed invoicing balances, full rights and ownership of customized source code developed specifically for a client deliverable are transferred to the client, subject to the conditions outlined in the executed Statement of Work (SOW).
4. Client Obligations & Conduct
When engaging our engineering teams or interacting with our online portals, you agree to:
- Provide accurate project specifications, assets, and operational access in a timely manner.
- Refrain from attempting reverse engineering, unauthorized access, or vulnerability exploitation on our infrastructure.
- Ensure all logos, media, and data provided to CyberSyon Software for integration do not infringe on third-party intellectual property rights.
5. Payments, Invoicing & Financial Terms
Project quotes and estimate schedules are valid for 30 days from issuance unless specified otherwise. Payment terms, deposit percentages, milestone triggers, and currency terms are governed by the corresponding project contract. Late payments may result in the temporary suspension of development sprints, cloud deployment pipelines, or support maintenance.
6. Warranties & Disclaimers
While CyberSyon Software follows rigorous quality assurance (QA) and testing cycles (SDLC), our website and public software portals are provided on an "as is" and "as available" basis. We make no express or implied warranties that site operations will be uninterrupted, error-free, or completely secure from external cyber threats.
7. Limitation of Liability
To the maximum extent permitted under applicable law, CyberSyon Software, its directors, employees, or technical partners shall not be held liable for any indirect, incidental, consequential, or punitive damages (including loss of business profits, operational downtime, or data loss) arising out of your use of our website or software services.
8. Confidentiality & Non-Disclosure
Both CyberSyon Software and the client agree to hold confidential all non-public technical code, corporate strategies, database structures, and financial terms disclosed during the consultation or execution phase, during and after the contract term.
9. Governing Law & Dispute Resolution
These Terms of Service are governed by and construed in accordance with the laws of India. Any legal disputes, arbitrations, or legal proceedings arising from or relating to these terms or our services shall fall under the exclusive jurisdiction of the competent courts located in Ernakulam, Kerala, India.
10. Modifications to Terms
We reserve the right to revise or update these Terms of Service at any time. Changes become effective immediately upon being published on this page. Your continued usage of our site or services after changes are posted constitutes acceptance of the modified terms.
